I have problem with one of my tenants who is in breech of contract.He now is 6 mouths rent
behind and refuses to listen to all letters and warnings issued out to him by National
RealEstate.
I am looking for the best fastest why i can get rid of him.This tenant has not
only damaged my property but is also doing work in my property ( spray painting car parts )
Which is causing problems with my other tenants cause of the fumes of the thinners and pant.
He is not paying hes water account and it very in arrears
What is the fastest way i can get rid of him ( legally ore illegally )and who are the
best people that can help
me to get rid of him.

The fastest way to evict a tenant is always to hire an attorney. They know the process, and can get him gone ASAP. You should have done this 6 months ago.

It is glaringly obvious you have no clue what you are doing. If you evict yourself, you may find the process taking 2-3 times as long as it should.

Renting and mold legal guidance?

Is there a lawyer knowledgable in landlord tenant laws on answers? The actual question is in the 3rd paragraph. Here’s background info: State: VA Situation: A few months ago, we reported to our property manager that there was mold growing in small areas all over the house on the ceiling. Black mold. We also reported green mold in one of the kitchen cupboards. They had a contractor out who sprayed the mold with a chemical I don’t remember. It wasn’t bleach, but it was suppose to "kill the mold and possibly prevent its return."

A couple months later, you guessed it, the mold is back, and getting worse by the day. We alerted the property manager and a few days later, the contractor was out again. This time, he looked in the crawl space under the house and the crawl space above the house. He found next to no insulation in the attic and a pipe that had a huge leak under the house. They plan on painting over the mold in the cabinet(yes, that came back) with a mold killing paint. I read on blackmold.awardspace that that should kill of the mold because the wooden cabinet was painted before the mold grew(as far as we know), so painting over it with a paint that seals of oxygen will kill the green mold.

I’ve gone through our lease and repairs and maintenance(although mold is never mentioned) is covered by the realty company.

That’s just fine, but my current issue is this: The property manager(claims to have 15 years of being a house inspector experience) has instructed us(the tenants) to use a 20% bleach and water mixture to clean the black mold on the ceiling. 1. As the mold was not caused my tenant negligence, it is not our responsibility to clean the mold right? I estimate this would take us at least 3 hours and we don’t have a way to reach the ceiling(chairs aren’t tall enough, don’t own a ladder). I know if we go buy a ladder and take the receipt to the manager, we’ll get reimbursed, but am I also correct in thinking that we are owed compensation for the time if we decided to take it upon ourselves to do the job? I read on http://realestate.msn.com/article.aspx?cp-documentid=22462661 about a tenant who was paid minimum wage for doing his dishes because his dishwasher was broken and the landlord didn’t want it fixed. 2. Anyone know this case so I can reference it? 3. Know a tenant union or housing authority near Hampton Roads? 4. Any other advice?

CORRECTION: My questions(yes, there’s multiple questions) now lie in the last paragraph.
Spoke with the rental company, they will be having the maid who cleans their properties out to clean the mold off the ceiling. However, they want to use bleach(20% bleach 80% water). The property manager wants the entire ceiling bleached(roughly 1100 sq ft), and also want us to cover our property with plastic so nothing gets bleached. They expected us to provide plastic, cover all our stuff ourselves, and to be vacant from the house(its a single family home) for a whole day. Well, that wasn’t going to work. If they want it cleaned with bleach, they can pay the maid to cover all my stuff with plastic they provide. If it’s not safe do be in the home, I expect a hotel/motel room provided for the duration of the temporary vacancy. The mold wasn’t due to tenant negligence, so it’s their responsibility to clean the property of the mold and all that that entails(protecting my property). I provided them a website(blackmold.awardspace.com) that lists other cleaners to
use against mold.

Like I said, I’m not spending 3 hours of my time doing their job unless they want to pay me. It doesn’t say anything about maid services in my lease, but it does say the house must be safe and habitable(hence they clean the mold and provide a hotel if the home is inhabitable for even a day). I’m sure the mold isn’t dangerous, but it is still nasty to have on a ceiling I’m paying $995 to look at. They haven’t gotten back to me since I gave them the web site. I’ll be calling them tomorrow and will not be doing business with this company again. I’d like to say thanks again for everyone’s time, sorry to vent. None of the answers stand out, so I’ll put it to a vote.

"black mold" would not grow on your ceiling. It requires raw, untreated wood, dampness and COMPLETE darkness.

Normally basic instructions on how to clean a house are not included in a lease. 1% bleach is enough to kill both mold and mildew (you have mildew). You are right, you do not have to clean this if you do not want to, however, unless maid service is part of your lease no one else will clean it either.

And no, the apartment will not reimburse you for a ladder. If you want a ladder you buy a ladder. Who doesn’t have a ladder?

You are not legally entitled to pay for cleaning your own house. I have never heard of a case where you were paid for basic cleaning, even that article you reference does not talk about cleaning, it talks about a dishwasher in the contract. If your contract states that the landlord cleans your apartment then yes, you could enforce that. If has to be in the contract though.

for the last year i have worked for one of sacramento’s mortage realestate companys. during that time i have witnessed my boss committing hundreds of thousands of dollars worth of insurance fraud, filing false police reports , theft, vandalism . who do i report this to and is there a reward ?

Realestate legal question?

A 10 acres parcel & house with a mortgage was split into two 5 acre parcels; one parcel of vacant land was combined [land combination]with an adjacent 1 acre parcel with a neighboring/different house.
However, the mortgage on the 10 acres was never cleared, the owner defaulted on the mortgage, and the sheriff sold the original 10 acres with house #1 at sale.
What legal authority is there to say the land combination was nullified/voided/whatever term should be used??

You need to ask yourself whether the Title company issued Title insurance on the sale of the parcel that was split off.

Essentially the mortgae should have been paid off at the sale of the 5 acre parcel. I doubt that a Title company would have issued Title Insurance if that mortgage had not been paid off.

If there was a Policy of Title Insurance Issued then you will have to look to the Title Company for compensation for your loss.

Yea, on Muffti Day its pretty much like the other days of the week except Friday you dress causual by still wearing your suit but leaving the brief case at home becuase its a long lunch day really long I think we got back Monday last time?

Oh and Bankers yeah well they could be a CPA or a MBA but usually and arts graduate or science graduate who had moved on say, from MacDonalds where it means an immediate fail on your resume to any self respecting QS firm unless you were so high up you can bring work in? The sender’s public name and addrees were :

"Yahoo! Real Estate" <realestate@one.yahoo-email.com>

Is that really from yahoo, or was it some kind of scam? If the latter, where should I signal it?

Australian Realestate Agents…Property Managers, Do they Know / Care How They Make People Feel??

I am yet to meet one who cares.
I Rent and buy, depending on work.
I am very upset every time I have to deal with one.
Is it a qualification to be to apply?
Do they have to make sure every customer knows that they are below society?
One even treated me like dirt, when I asked for them to manage one of my rental properties.

Real-estate Agents are a dime a dozen, anyone can be one, yet they all display "Qualities that they are above everyone Else"

What’s your excuse?
Finally after years of brainwashing, they are gods gift, earning $150K??
Is that it?
Majority are from broken households, and did not have professional parents. Does the suit, make them feel so much worth, it’s uncontrollable??

I’m not a real estate agent – here is my guess:-

Some probably didn’t quite treat you well because they themselves were not paid well for managing rental properties. You know, the usual overworked underpaid. There’s only so much a staff member can handle. Nothing much you can do about this.

Some who still treated you bad when you buying – it’s probably because you didn’t buy a million or two million dollar worth of property. I bought a very cheap property in the past. And yes the agent treated me like I was some stinky rubbish…… (not quite sure how to describe it but you know what I mean). Cheap property = low commission. *shrug* what can you do?

I think it’s not limited to Real Estate agents – I think it’s all sales persons to a certain degree. RE agents also not to all RE agents. You serve people who bring you the most money…

why wont they accept us when we apply for houses realestate?

Hello, i am 27 my partner is 22 and our son is 8 months almost 9 months on the 22nd

we apply for houses but they allways knock us back they said they dont have to give us a reason why yet they wont give us a house what do we do and how do we get a foot in the door we have never rented before so how can we we need a rental history they tell us but they dont give us a chance to get one

please help we cant keep livein in our parents house 3 of us all in the one room our son needs his room and our roon is not biigenuff for a cot so he is in a porta cot
first off all not every one was braught up with money . and just beacause our spelling is not great is no reason to decline u for a house (so dont be so freakin rude ) and we do write neat we have have jobs as our area we live in there is no jobs avalibale for us (do no judge ) when u dont know the reasons and we dont have a rental history as we have been liveing with parents and there is NOTHIGN wrong with liveing with ur parents as long as u can and also our education has sweet fuck all to do with gettin a house
why do u all bother to answer people if u just going to put people down

I am unclear if you are employed. If you aren’t no one is renting to you.

You have never left home at 27?

If you are employed you will need a co-signer, someone with good credit, income and of course willing to be sued if you are a dead beat.
