Realestate legal question?

A 10 acres parcel & house with a mortgage was split into two 5 acre parcels; one parcel of vacant land was combined [land combination]with an adjacent 1 acre parcel with a neighboring/different house.
However, the mortgage on the 10 acres was never cleared, the owner defaulted on the mortgage, and the sheriff sold the original 10 acres with house #1 at sale.
What legal authority is there to say the land combination was nullified/voided/whatever term should be used??

You need to ask yourself whether the Title company issued Title insurance on the sale of the parcel that was split off.

Essentially the mortgae should have been paid off at the sale of the 5 acre parcel. I doubt that a Title company would have issued Title Insurance if that mortgage had not been paid off.

If there was a Policy of Title Insurance Issued then you will have to look to the Title Company for compensation for your loss.

i was at my moms house after work she has cable i think it was msn it was cable. it was about the housing crash they where talk in to bush and they where talk in to the people that lend out the money for the homes the people where telling there story’s, some people where talk in off in a island i don’t know where and the people on the island where ta kin cuts. and at the end they told one of the realestate people hey how do you feel now that you did this and he went back just made faces

Is a realestate contract binding or void if the lender does not sign the borrowers copys?

I helped my daughter purchace her first home. After one year she was unable to continue making her mortgage payments. We tried to get a loan modification but was denied. I reviewed the contract and noticed that the lender did not sign any of the documents.

The contract of sale would be signed by buyer and seller- not by mortgage company. Even if some of the contract paperwork is not binding for some reason- the fact that your daughter signed the closing documents shows that she was OK with what had been agreed.

If you are talking about loan documents that she got at closing- she may have gotten copies that were not yet signed by mortgage company at closing. She could have gotten copies later that had signatures- or the signed ones may have been sent directly to county. It is possible someone made a bad mistake- but not very likely. You would have to hire a good local real estate lawyer to get a good idea.

Quantity Surveying is one of the most noble and trusted Fiduciary fields where exacting mathematics, attention to detail, skills in negotiation, law, finance, project managment mean in England its a bit of a joke in the book shop scene where Ethel the Aardvark goes merrily on his way down the road? Yea, on Muffti Day its pretty much like the other days of the week except Friday you dress causual by still wearing your suit but leaving the brief case at home becuase its a long lunch day really long I think we got back Monday last time?

Oh and Bankers yeah well they could be a CPA or a MBA but usually and arts graduate or science graduate who had moved on say, from MacDonalds where it means an immediate fail on your resume to any self respecting QS firm unless you were so high up you can bring work in? From the Bank, never Macdonalds, please???

I received a spam ad for foreclosure real estate deals.
The sender’s public name and addrees were :

"Yahoo! Real Estate" <realestate@one.yahoo-email.com>

Is that really from yahoo, or was it some kind of scam? If the latter, where should I signal it?

Couching Up Chunks of Blood Due to Black Mold in Private Rental! Please Help!!!?

We were all living in a house with black mold riddled throughout the kitchen cupboards and bathroom to the state where we couldn’t actually use the kitchen or bathroom for the last 3 months of our tenancy. My partner had several asthma attacks (he has never had one in his life) and we would both got terrible uncontrollable trembles throughout the night.
The trembles have stopped since we moved out, and he can breath easier but for me, I had a miscarriage while we were living there and have also been coughing up chunks of blood for the past 5 months. Now, I know that there is no proof that the miscarriage was caused by the black mold but what about the chunks of blood!

We had ongoing issues with the Real Estate as they were not prepared to remove the mold, so basically we had no choice but to continue living there. We were unable to use the kitchen or bathroom for 3 months and the place completely stank! Finaly we took it upon ourselves to hire a private contracter to remove the cupbourds in the kitchen, but it still didn’t work. Anyways, I was becoming that sick that we had no choice but to end the lease early, as we were scared that our 2 young children would get sick. We were absolutely homeless for 2 months because of these lowsy bastards! we have found a rental again, we are now settled in a clean environment.

As you can understand I am absolutely discusted with this Real Estate, for not fixing the mold problem and it has been 5 months and I am still coughing up chunks of blood!!!

I want to take them to court, but I am not sure that there is any proof that the symptoms can be proven to be caused by black mold exposure.

Does anyone have any suggestions?

Advocasy & rights aren’t prepared to help because the realestate said they would counter claim for the removal of the cupbourds. I have photoes of everything, it was discusting.

Perhaps you could get a doctor’s evaluation to establish that the mold was a cause of the problem. Black mold can kill. This sounds like a lawsuit is in order.

I’m not sure if that makes sense…

What I would like is some sort of statistics/data overlaid with a map of Australia (or any region within Australia) so I can compare possible future areas I might like to live in. I’d find this easier than just having a written list and having to sort through names of suburbs.

Info I would like to compare:

Climate – average temp, rainfall etc (though I could always go to a meteorological site after choosing a few locations)

Average rental price/ vacancy rate

Incidences/risk of natural disasters like flooding, bushfires, cyclones etc

Unemployment rate/ general outlook on the job market (with maybe a clickable thing to show the breakdown of jobs into various industries; e.g. lots of mining jobs around Perth)

Transport – how accessible/affordable/reliable is the public transport? What’s the road quality and commute like? Is it easy to find your way around? What’s the petrol price like?

Crime – maybe an overview, like a heads-up if an area is right in between two very violent rival gangs or something. Would it even be public record to show statistics like how many arrests were made in a year and for what sorts of reasons (domestics, drugs, theft, violence, drink driving or whatever the main categories are)?

Maybe even a basic profile of the kind of people who live there. That could be very stereotypical I know, but I don’t want to move into an area full of snobby homophobic religious types, and if it attracts a certain ethnic group I’d like to choose which one so I can practice my language skills and actually enjoy the food when I invite my neighbours over for a pot-luck dinner.

If that’s too much, could you help me with a website that could provide me with just one of the above? For example, does a website like realestate.com.au have a page showing the median rental price for the different areas based on what’s been advertised on there?

I am yet to meet one who cares.
I Rent and buy, depending on work.
I am very upset every time I have to deal with one.
Is it a qualification to be to apply?
Do they have to make sure every customer knows that they are below society?
One even treated me like dirt, when I asked for them to manage one of my rental properties.

Real-estate Agents are a dime a dozen, anyone can be one, yet they all display "Qualities that they are above everyone Else"

What’s your excuse?
Finally after years of brainwashing, they are gods gift, earning $150K??
Is that it?
Majority are from broken households, and did not have professional parents. Does the suit, make them feel so much worth, it’s uncontrollable??

I’m not a real estate agent – here is my guess:-

Some probably didn’t quite treat you well because they themselves were not paid well for managing rental properties. You know, the usual overworked underpaid. There’s only so much a staff member can handle. Nothing much you can do about this.

Some who still treated you bad when you buying – it’s probably because you didn’t buy a million or two million dollar worth of property. I bought a very cheap property in the past. And yes the agent treated me like I was some stinky rubbish…… (not quite sure how to describe it but you know what I mean). Cheap property = low commission. *shrug* what can you do?

I think it’s not limited to Real Estate agents – I think it’s all sales persons to a certain degree. RE agents also not to all RE agents. You serve people who bring you the most money…

why wont they accept us when we apply for houses realestate?

Hello, i am 27 my partner is 22 and our son is 8 months almost 9 months on the 22nd

we apply for houses but they allways knock us back they said they dont have to give us a reason why yet they wont give us a house what do we do and how do we get a foot in the door we have never rented before so how can we we need a rental history they tell us but they dont give us a chance to get one

please help we cant keep livein in our parents house 3 of us all in the one room our son needs his room and our roon is not biigenuff for a cot so he is in a porta cot
first off all not every one was braught up with money . and just beacause our spelling is not great is no reason to decline u for a house (so dont be so freakin rude ) and we do write neat we have have jobs as our area we live in there is no jobs avalibale for us (do no judge ) when u dont know the reasons and we dont have a rental history as we have been liveing with parents and there is NOTHIGN wrong with liveing with ur parents as long as u can and also our education has sweet fuck all to do with gettin a house
why do u all bother to answer people if u just going to put people down

I am unclear if you are employed. If you aren’t no one is renting to you.

You have never left home at 27?

If you are employed you will need a co-signer, someone with good credit, income and of course willing to be sued if you are a dead beat.
